Requirements for those Divorced outside of Canada

The following information outlines the requirements for those divorced outside of Canada who wish to purchase an Ontario Wedding Licence. At a certain point in this process, you will need to engage the services of a lawyer who specializes in Ontario Family Law.

  1. To obtain a marriage licence you will need a completed marriage license application signed by both applicants available at most City Halls in Ontario. To print off an application for a wedding licence go to: www.ccr.gov.on.ca/mccr/english/2542_3fe.htm
  2. However since you are Divorced out side Canada you must first jump through several hurdles before you can purchase a licence. The Government must be told by an Ontario lawyer that your Divorce is legal.
    Important. At the time you get an application for a marriage licence you will also need to obtain 'A Statement of Sole Responsibility' form at the same City Hall. The Statement of Sole Responsibility for each divorce must be signed by both applicants and properly witnessed.
  3. You will need your original divorce or a copy certified by the administrative office of the court in the granting jurisdiction, or a sealed or otherwise properly authenticated document by the court. When the divorce is in a language other than English or French a certified translation, from someone other than one of the applicants, is also required. These documents will be returned to the applicants.
  4. Next you need to get all this documentation to an Ontario lawyer. The lawyer gives you a legal opinion of your documents. It will be addressed to both applicants, stating that the divorce(s) would be recognized as valid in the Province Of Ontario and clearly providing the reasons for recognition, which must include reference to the relevant facts and the specific basis for recognition.
  5. The completed package can then be sent by your lawyer or yourselves , to the office of the Office of the Registrar General who issues a 'Permission to Obtain a Ontario Marriage Licence ' form to you.
  6. You take this permission to the City Hall, and then purchase your licence.
